1. Scope
The following Terms and Conditions (T&Cs) of SI matratzenland GmbH apply to all orders for products and services placed via our online shop as well as by telephone, in writing, or by e-mail.
They govern the contractual relationship between SI matratzenland GmbH and the buyer. SI matratzenland GmbH undertakes to process and provide its services carefully in accordance with these T&Cs.
Collateral agreements or deviating arrangements shall only be valid if made in writing and confirmed by SI matratzenland GmbH.
2. Conclusion of Contract
The presentation of products in the online shop constitutes a non-binding online catalogue and does not represent a legally binding offer.
By clicking the “buy” button, the customer places a binding order. The contract is concluded upon dispatch of the order confirmation by e-mail.
Orders placed by telephone, in writing, or by e-mail are also considered legally valid.
All offers are subject to change without notice. Changes and errors remain reserved.
2.1 Product Presentation
The ordered goods may differ slightly from the products shown on the internet due to technical display differences, in particular with regard to colour, structure, or illustration. Such deviations do not constitute a defect.
3. Offers and Prices
All prices include the statutory value added tax of 8.1% as well as all price components.
Despite the greatest care, incorrect information cannot be completely ruled out. All price indications are non-binding.
SI matratzenland GmbH shall not be liable for unavailable products or incorrect price information.
Upon the order confirmation, SI matratzenland GmbH undertakes to deliver the goods and the customer undertakes to accept the ordered goods.
3.1 Delivery Time
Information on delivery times is available on the respective product pages and is based on the current status.
Delivery delays do not entitle the customer to cancel the order or claim damages.
Fixed delivery dates shall only apply if expressly confirmed in writing by SI matratzenland GmbH.
3.2 Delivery
The customer is obliged to check the goods for completeness and correctness upon handover.
Transport damage must be reported immediately and, where possible, photographed and recorded in writing.
Deliveries are carried out by:
- Swiss Post
- our in-house delivery service
- external transport companies or carriers
Standard delivery is made to the curbside. Transport into the apartment, bedroom, or to the intended place of use is only owed if a corresponding additional service has been expressly booked.
In the event of difficult delivery conditions, lack of access, or further additional effort, the customer shall bear the resulting additional costs.
The risk passes to the customer upon handover of the goods to the customer or to a person designated by the customer.
4. Right of Withdrawal / Return / Exchange
4.1 Principle
A right of withdrawal or return does not mean a free return.
A return is only possible for unused and originally packaged standard products that were not specially produced or ordered for the customer.
4.2 Exclusion of the Right of Withdrawal and Return
The following in particular are excluded from the right of withdrawal and return:
- individually produced or made-to-order goods, e.g. mattresses from Swiss brands such as BICO
- custom-made items, special sizes, extra lengths, and extra widths
- beds and bedding contents
- hygiene items once opened
- clearance and sale items
For these products, there is no right of withdrawal, no right of return, and no entitlement to a refund.
4.2.1 Goodwill Policy for Special Products
In exceptional cases, a return or exchange of originally packaged and unused products may be considered on a goodwill basis.
This applies in particular to products from Swiss brands or goods made to order.
Such a return shall be carried out exclusively under the following conditions:
- no money-back guarantee
- return or exchange only against full assumption of costs by the customer
- charging of transport, carrier, and logistics costs
- charging of processing and material costs
- charging of costs already incurred, in particular for production, ordering, and disposition
- possibility of an exchange for another product with a corresponding price adjustment
There is no entitlement to such a goodwill solution.
4.3 Return of Standard Products
If a return of eligible standard products is possible, it shall only be carried out subject to charges.
The customer shall bear all costs, in particular:
- return transport and shipping costs
- carrier and logistics costs
- material and processing costs
4.4 Refund / Voucher
Refunds shall be made exclusively in the form of a voucher.
A payout in cash or to the originally used payment method is excluded.
A money-back guarantee is expressly excluded.
4.5 Condition of the Goods
A withdrawal, return, or exchange is excluded if:
- the goods have been opened
- signs of use are present
- the original packaging is damaged
4.6 Deadline
The withdrawal must be made in writing within 14 days after receipt of the goods.
Compliance with the deadline is determined by the date of dispatch.

5. Payment Methods for Switzerland and Liechtenstein
The purchase of our products is possible using the following payment methods:
5.1 Advance Payment
After submitting the order, you will receive an order confirmation with the required payment information. Delivery takes place after receipt of payment.
5.2 E-Banking
Payment is made in accordance with the bank details provided. Delivery takes place after receipt of payment.
5.3 Cash Payment
Cash payment is possible upon delivery or collection.
5.4 PayPal / PayPal Express
Payment is made via your PayPal account in accordance with the applicable terms there.
5.5 Credit Card
Payment can be made via PostFinance, VISA, Mastercard, TWINT, and other offered payment methods. The invoice amount is charged at the time of the order.
5.6 Purchase on Invoice (POWERPAY)
For purchases on invoice, processing is carried out by MF Group / POWERPAY in accordance with their T&Cs. By choosing this payment method, the customer also accepts the terms of POWERPAY.
5.7 Payments from Europe
Orders from Germany, France, Belgium, and Austria may only be paid by credit card, PayPal, bank transfer, or advance payment.
6. Default in Payment
In the event of default in payment, a reminder fee of CHF 45.– shall be charged.
From the third reminder onwards, default interest of 10% shall be charged.
Further costs incurred, in particular debt collection, storage, and processing costs, shall be charged in full.
SI matratzenland GmbH is entitled to assign outstanding claims to a debt collection company.
7. Refusal of Acceptance and Delay in Acceptance
In the event of unjustified refusal to accept delivery, all costs incurred shall be charged. The right to performance of the purchase contract remains unaffected.
7.1 Delay in Acceptance
If the customer is in delay of acceptance, SI matratzenland GmbH is entitled to charge all resulting costs, in particular storage, transport, and additional costs.
7.2 Cancellation / Annulment
Cancellation or annulment of orders is generally not provided for, as a binding purchase contract is concluded upon completion of the order.
If, by way of exception, a cancellation request is made before delivery, SI matratzenland GmbH reserves the right to charge an administrative compensation fee of CHF 50.– to CHF 150.–. The specific amount depends on the actual effort incurred.
In the event of increased effort, e.g. extensive communication, manufacturer orders already triggered, or special clarifications, the administrative compensation may be correspondingly higher.
Third-party costs already incurred, in particular manufacturer, logistics, or processing costs, shall in any case be charged in full.
Without express written confirmation of the cancellation by SI matratzenland GmbH, the order remains binding.
8. Warranty and Liability
The warranty provisions of the respective manufacturer shall apply.
Transport, packaging, and assembly costs are not part of the warranty and may be charged separately.
There is no entitlement to replacement products for the duration of a repair.
8.1 Limitation of Liability
To the extent permitted by law, the liability of SI matratzenland GmbH is excluded.
In particular, SI matratzenland GmbH shall not be liable for:
- indirect damage and consequential damage
- loss of profit
- damage resulting from delivery delays
- damage caused by improper use, inadequate care, or natural wear and tear
Mandatory statutory provisions remain reserved.
9. Retention of Title
The goods remain the property of SI matratzenland GmbH until full payment has been made.
Resale or pledging is not permitted until full payment has been made.
10. Copyright
All texts, offers, images, and other representations on the website are protected by copyright and belong to the intellectual and material property of SI matratzenland GmbH.
Illustrative deviations, typographical errors, mistakes, and changes remain reserved.
All technical information on individual goods is based on the manufacturers’ information and is non-binding.
11. Applicable Law and Place of Jurisdiction
The present contractual relationship is governed exclusively by Swiss law.
The place of jurisdiction is Stansstad, Canton of Nidwalden, Switzerland.
12. Severability Clause
Should individual provisions of these T&Cs be wholly or partially void or ineffective, the validity and effectiveness of the remaining provisions shall remain unaffected.
The invalid or ineffective provisions shall be replaced by such provisions as come as close as legally possible to the economic purpose of the invalid provision. The same shall apply in the event of any gaps in the provisions.
